These Terms and Conditions govern your use of the DeckPro website and any engagement of DeckPro services. Please read them carefully before using this website or entering into any project discussion or agreement with DeckPro.

1. Acceptance of Terms

By accessing or using the DeckPro website (deckpro.space) or engaging DeckPro for any services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use this website or engage our services. These terms apply to all visitors, prospective clients, and current clients.

2. About DeckPro

DeckPro is a digital systems and custom software development brand operating under Clairzun. We provide services including but not limited to custom web application development, website design and development, internal business tools and portals, automation systems, UI/UX design, MVP development, Shopify e-commerce builds, and technical consulting. All services are delivered on a project basis and governed by individual project agreements.

3. Use of This Website

This website is provided for informational purposes only. You may use this website for lawful purposes to learn about DeckPro services, view case studies, read published content, and make contact inquiries. You agree not to misuse this website, interfere with its operation, attempt to gain unauthorised access to any system or server, transmit harmful or malicious code, scrape content without permission, or use the site in any way that violates applicable laws or regulations.

4. Service Descriptions and Accuracy

All service descriptions, case study examples, project timelines, outcomes, and illustrations on this website are provided for general information only. They represent examples of past work and general capabilities and do not constitute a guarantee, warranty, or binding offer. No content on this website creates a contractual obligation unless separately confirmed in a written proposal, signed agreement, or formal statement of work issued by DeckPro.

5. Project Engagements and Agreements

Each project engagement with DeckPro is governed by a separate proposal, statement of work, or project agreement that outlines the specific scope, deliverables, milestones, payment schedule, timeline, and responsibilities of both parties. In the event of any conflict between these Terms and Conditions and a signed project agreement, the signed project agreement will take precedence. DeckPro reserves the right to decline any project inquiry at its discretion.

6. Payments and Fees

Project fees, payment schedules, deposit requirements, and invoicing terms are defined in individual project agreements. Unless otherwise specified in writing, DeckPro may require a deposit before commencing any work. Invoices are due within the timeframe stated on each invoice. Late payments may result in work being paused or delayed. DeckPro reserves the right to charge interest on overdue balances at a rate permitted by applicable law. All fees are exclusive of applicable taxes unless otherwise stated.

7. Client Responsibilities

Clients are responsible for providing accurate and complete project requirements, timely feedback, approvals, required access credentials, brand assets, content, and any other materials needed for project delivery. Delays caused by incomplete information, late approvals, or lack of availability from the client may affect project timelines and delivery dates. DeckPro will not be held responsible for delays that are directly attributable to the client's failure to fulfil these responsibilities.

8. Revisions and Scope Changes

Any changes to the agreed project scope, features, design, or deliverables that fall outside the original brief may require a revised quote and additional timeline. DeckPro will notify the client in writing of any scope changes and associated costs before proceeding. Verbal approvals for scope changes will be followed up with written confirmation. Requesting additional work without agreeing on updated fees does not obligate DeckPro to deliver that work.

9. Intellectual Property

All DeckPro website content, branding, written materials, code used for demonstration purposes, and proprietary frameworks are protected by applicable intellectual property rights and remain the property of DeckPro or its licensors. Upon full payment of all agreed project fees, clients receive the intellectual property rights to custom deliverables as specified in the project agreement. DeckPro retains the right to display completed work in its portfolio and case studies unless the client requests otherwise in writing. Third-party libraries, tools, fonts, plugins, or platforms used in a project remain subject to their respective licences.

10. Confidentiality

DeckPro treats all client information, business processes, operational data, access credentials, and project details as confidential and will not share this information with third parties except as required to deliver the project or as required by law. Clients should not share access credentials, sensitive financial data, or regulated personal data via unsecured channels. Where a mutual NDA is required, this should be agreed in writing before sharing any sensitive materials.

11. Third-Party Services and Platforms

Projects may involve third-party hosting providers, domain registrars, content delivery networks, APIs, SaaS platforms, payment gateways, Shopify, analytics tools, AI services, email providers, or other external systems. DeckPro is not responsible for the uptime, data practices, pricing changes, feature removals, policy changes, or any failure of third-party services. Clients are responsible for maintaining their own accounts and agreements with third-party platforms after project handover.

12. Warranties and Disclaimers

DeckPro warrants that services will be delivered with reasonable skill and care in accordance with the agreed project brief. DeckPro does not warrant that delivered software will be entirely free of defects or that it will operate without interruption. Any defect correction or support after project delivery is subject to a separate maintenance agreement unless specified otherwise. The website and its content are provided on an "as is" basis without any warranty of fitness for a particular purpose or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by applicable law, DeckPro's total liability for any claim arising from a project engagement shall not exceed the total fees paid by the client for that specific project. DeckPro shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or loss of goodwill, even if DeckPro has been advised of the possibility of such damages. Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

14. Termination

Either party may terminate a project engagement in accordance with the terms set out in the applicable project agreement. If no termination clause is specified, either party may terminate with written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. DeckPro will provide all completed deliverables upon receipt of any outstanding payments. DeckPro reserves the right to immediately suspend services if a client is in material breach of these terms or any project agreement.

15. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with applicable law. Any disputes arising from these terms or from any project engagement shall be subject to the exclusive jurisdiction of the courts of the relevant territory. DeckPro encourages clients to raise any concerns directly so that disputes can be resolved amicably before any formal proceedings.

16. Changes to These Terms

DeckPro reserves the right to update or amend these Terms and Conditions at any time. Updated terms will be published on this page with a revised date. Continued use of this website or ongoing engagement with DeckPro after changes have been published constitutes acceptance of the updated terms. For active project agreements, the terms in effect at the time the agreement was signed will continue to apply unless both parties agree to updated terms in writing.
